RULES AND REGULATIONS OF CEMETERY
The Rules and Regulations of Cemetery supplement the Deed restrictions. Any violation of the
restrictions set forth on the deed and/or the rules and regulations set forth below will result in
cemetery staff removing any and all restricted items.
WHEREAS, Fair Oaks Cemetery is the final resting place for generations of people dating back
to the 1700s, and
WHEREAS the Wilmington Cemetery Association, the governing board of Fair Oaks
Cemetery, is committed to ensuring that the cemetery grounds, including all individual burial
plots, reflect the peace and solemnity of this resting place;
NOW THEREFORE:
1. All regular maintenance of grounds and individual plots such as mowing and trimming shall
be done by cemetery staff and/or contractor hired for said maintenance. Cemetery staff and/or
contractors are not responsible for watering or weeding flowers planted by family members.
2. Headstones and footers shall be installed by contractors skilled in this work and approved by
the Wilmington Cemetery Association and such work shall be coordinated with the Cemetery caretaker.
3. Plot owners and families are permitted 2 feet of space directly in front of the headstone* for decorations such as flowers or wreaths. Space for flowers is 12”-18” depending on section, and wreath stands permitted within 2’. No plants, decorations, or adornments of any kind are permitted on the sides of headstone or behind headstones.
4. Any planting must first be approved by the Cemetery caretaker. Many plants are invasive in
nature and can cause damage.
5. Artificial flowers adorning the plot must be in appropriate containers and must be secured so
that wind and rain do not scatter them. (i.e. no artificial flower stems stuck in the ground)
6. Holiday flowers and wreaths must be secured so that wind and rain do not scatter them.
7. Holiday flowers and wreaths belong to the donor and must be removed in a timely manner
after the subject holiday. If not timely removed, the Cemetery will dispose of said items.
* Headstone: The stone placed at the head of the grave plot.
Shepherds hooks, windchimes, windmills, balloons, and yard decorations (except solar lights and yard flags) are not permitted.
Do not leave personal items or food and beverages on graves. If this is part of a religious practice, please talk to caretaker for permission.
We encourage you to read over your deeds and to remove items not in compliance if you wish to keep them. Once they are removed by groundskeepers they will not be returned.
